Lt.Col. Purohit Hits back: Ray of Hope for Col Purohit as Supreme Court Of India Issues Notice

In a big development in the 2008 Malegaon blasts case, the Supreme Court of India on Monday issued a notice to the National Investigation Agency (NIA) and the Maharashtra government on the plea by Lt Colonel Srikant Purohit that had sought the dismissal of the Unlawful Activities Prevention Act (UAPA) case against him.

Colonel Purohit had moved the apex court against the Bombay High Court’s order dismissing his plea to quash a decision by a special court to take cognizance of offenses against him in the 2008 Malegaon blasts case without a “valid sanction” for prosecution.

In response, the Supreme Court has directed the NIA to file a reply within four weeks.

Earlier, in December, the NIA had discharged Lt Col Purohit under MCOCA (Maharashtra Control Of Organised Crime Act). At that time, speaking exclusively to Republic TV, Lt Col Purohit’s lawyer Neela Gokhale had said that the NIA didn’t have a sanction to prosecute him under the UAPA Section 18.

Republic TV spoke exclusively to Lt Colonel Purohit after the Supreme Court issued its notice. He maintained a dignified silence on the questions posed to him on the Hindu terror theory, only choosing to say “Jai Hind” and that he was “proud to serve the Army, no doubt about is”
